So, I called up and talked to the WV DMV Medical CDL Department in Charleston. I was told that they do offer a Medical Waiver from the State DMV and it is a 2 page form that your primary care doctor who prescribes you the insulin would fill out. There is an additional page where you describe the vehicle that you wish to drive (Size of vehicle) and where you intend to drive it (Delivery region).
She said that with diabetes you do have to also get a yearly eye exam to show your vision is still in normal range from a licensed eye doctor (This is because diabetes can greatly speed up vision loss if not controlled). And, yes, even if you passed the eye chart when you passed you DOT CDL Medical Fitness exam, you still must get the eye doctor exam once a year.
In other words, if you are trying to drive a commercial vehicle within WV and you use insulin, first you need to pass a DOT Medical Fitness Exam. Then you request the waiver from the state by calling the Medical CDL Department at the WV DMV at 304-926-3691. They send you the paper work and you then fill out your part and have your primary care doctor fill out their part and get the eye exam part filled out by an eye doctor. You return this to the WV DMV with a copy of your DOT physical exam (Long Form and Short Form).
The nice lady I talked to at the Charleston office said the turn around time is 2 days on average. That means that you should get your waiver within just a few days of sending the paperwork in. She did note that the state does not just give the waivers out to anyone. She said they only mail the waiver paperwork to you upon your request and they require your license number and name at that time so that they can downgrade your license if you do not comply.
Waivers by the state for in state driving (Intrastate) are available for Diabetes, Vision, Loss of limb, and Seizures. With seizures you can get a waiver on seizure medication for in state operation as long as No Seizures in 3-years.
